These terms apply when you use this website and when you rent the FocusTraining system. They're written to be readable. If something here is unclear, ask us before you sign anything.
1. Who these terms are with
This website and the FocusTraining program are operated by Trans Factor Inc., a company located in California, USA ("FocusTraining", "we", "us"). By using this site you agree to these terms. If you don't agree, please don't use the site.
2. This is not medical advice
FocusTraining provides cognitive training programs. We are not a healthcare provider, and nothing on this website or in our program is medical advice, diagnosis or treatment.
- The system is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition.
- Nothing we provide replaces evaluation, advice or care from a licensed healthcare professional.
- Do not stop, start or change any medication or treatment based on anything we say. Talk to your physician.
- If you or someone you care for is in crisis or needs urgent help, contact a medical professional or emergency services.
3. Results
We describe what research on attention and neurofeedback training has reported, and we don't overstate it. Outcomes vary between individuals, and no approach works for everyone. Nothing on this site is a promise, guarantee or warranty of any particular result, improvement, score or outcome.
4. Renting the system
The following is a summary. The signed rental agreement is the controlling document, and if anything here conflicts with it, the signed agreement governs.
Term and cancellation
The minimum rental period is one month. After that the rental continues month to month until you tell us you're finished and return the equipment. There is no long-term contract and no cancellation penalty.
Pricing
The current rental rate is $240 per month and covers unlimited users on one system. Shipping and insurance are quoted separately depending on destination. Prices shown on this site are in US dollars and may change; the rate in your signed agreement is the rate you pay for the duration of that agreement.
Payment
Rental fees are charged monthly in advance. If a payment fails we will contact you; if it remains unpaid we may suspend support and require the equipment to be returned.
Shipping and return
We ship the system to you. When you finish, return shipping is arranged and paid by you. We will provide return instructions and the return address. We strongly recommend returning the equipment insured and with tracking, because responsibility for it remains with you until we receive it.
Your responsibility for the equipment
Ownership of the equipment remains with us at all times. While it is in your care you are responsible for it:
- Use it only as instructed, and only for its intended purpose.
- Do not open, modify, repair, sell, lend, sublease or transfer it.
- Normal wear from everyday training is expected and is not charged for.
- If the equipment is lost, stolen, or damaged beyond normal use, you are responsible for the repair or replacement cost as set out in the rental agreement.
- Tell us promptly if something is damaged, lost or stops working.
Software and access
Any software, accounts or content provided with the system are licensed to you for the duration of the rental, for your own use, and not sold. That licence ends when the rental ends.
5. Using this website
You may use this site for lawful purposes only. Please don't attempt to gain unauthorized access to it, interfere with its operation, scrape it at a volume that degrades service for others, or submit false information or spam through the contact form.
6. Intellectual property
The text, design, graphics, and other material on this site belong to FocusTraining or its licensors, and are protected by copyright and other laws. You may view and print pages for your own reference. You may not republish, sell or redistribute the content, or use our name or branding, without our written permission.
7. Third-party links
Where we link to another website, we do so for convenience. We don't control those sites and aren't responsible for their content, products or privacy practices.
8. Disclaimer of warranties
Except where the law does not allow it, this website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free. Warranties relating to the rented equipment, if any, are set out in the rental agreement.
9. Limitation of liability
To the fullest extent permitted by law, FocusTraining and its owners, officers and staff will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of this website or the program. Our total liability for any claim relating to the rental will not exceed the amount you paid us in the twelve months before the claim arose.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence.
10. Indemnity
You agree to indemnify and hold FocusTraining harmless from claims, losses and reasonable legal costs arising from your misuse of the equipment, your breach of these terms or the rental agreement, or your violation of any law or third-party right.
11. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
12. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you and we consent to the jurisdiction of those courts.
Before filing anything, please contact us — most problems are faster to solve directly, and we would rather fix it than argue about it.
13. Changes
We may update these terms. The date at the top shows when they last changed. Changes apply to your use of the site from the date they're posted; they do not change the terms of a rental agreement you have already signed.
14. Severability
If any provision of these terms is found unenforceable, the rest remains in effect.
